How to prove financial capacity
To work as a freight forwarder, two main requirements must be met:
- Financial capacity guarantee (art. 6, Law 1442/1941)
- Security deposit (art. 10, paragraph 2, Law 1442/1941)
1. Financial capacity guarantee
The financial capacity guarantee means demonstrating a minimum amount of €100,000.00. It can be met in different ways, depending on the legal form of the business:
- Companies (S.p.A., S.r.l., S.a.s., S.n.c.): a fully paid-up share capital of at least €100,000 is required. If the paid-up capital is lower, the missing amount must be covered by a bank guarantee or insurance surety bond (tacitly renewable).
- Sole proprietorships and cooperatives: financial capacity can be proven through real estate, a restricted deposit of cash or securities, or a bank or insurance guarantee (always tacitly renewable), for a total of at least €100,000.
Sole proprietorships that choose to prove capacity through real estate must submit an appraisal by a qualified professional certifying the minimum value of €100,000, ownership and the absence of significant encumbrances (mortgages, etc.).
This requirement must be confirmed every year.
The guarantee must be issued in favour of the Chamber of Commerce for the entire duration of the business and renewed automatically every year. It can only be released with the authorisation of the competent Chamber of Commerce.
2. Security deposit for freight forwarders
In addition to the financial capacity guarantee, a mandatory security deposit must be lodged with the competent local Chamber of Commerce, to cover the obligations arising from the professional activity of freight forwarder.
- Required amount: €258 (Province of Bolzano)
The deposit can be provided through:
- a restricted deposit of cash or securities
- a bank guarantee
- an insurance surety bond
The deposit remains restricted in favour of the competent Chamber of Commerce for the entire duration of the business and can only be released with the authorisation of the same Chamber of Commerce.
