What is the purpose of the surety for the cross-border transport of waste?

Companies involved in waste transport, subject to notification, across national borders, guarantee, the Province operating on behalf of the Ministry of the Environment, any costs that it should incur in case of environmental disaster, for the remediation of polluted sites and expenses for recovery, transport, and disposal of the waste itself until receipt by the competent authorities of the certificate of correct disposal.

As a guarantee for the cross-border transport of waste, the Ministry requires an Insurance Surety for each journey.

The Sureties for cross-border waste transport must be issued by insurance companies authorized to operate in the sureties sector or with bank sureties issued by banks.

When must the surety be presented?

The Insurance Surety must be presented after the release of the authorizations by all the competent Authorities and in any case before the start of the shipments, but each Province may require different timings.

In case of general notification, Insurance Sureties can also guarantee “individual parts of the notification” and therefore a partial number of shipments compared to those total authorized.

How is the amount to be guaranteed calculated?

Which section of the Environmental Management Register should I register in to carry out cross-border waste transport?

Category 6 of the Environmental Management Register concerns the transport of waste across international borders. To do this in Italy, companies must register in the Environmental Management Register as required by law.

The National Committee has established rules and requirements for registering in this Category 6, which concerns the cross-border transport of waste. They have also provided details on which documents must be submitted when requesting registration, especially regarding the translation into Italian of foreign documents.

To request registration, companies must do so online, using the website of the regional or provincial section concerned if they have branches in Italy or if they choose to establish their legal headquarters in Italy. Otherwise, they can submit the application through a regional or provincial section of their choice using a certified email address (PEC) in the name of the company.

In addition, Category 6 is divided into different classes based on the amount of waste transported each year, and there are specific requirements for each class.

Financial requirement: To demonstrate that you have the necessary money, you must have at least € 9,000.00 if you have only one vehicle and € 5,000.00 more for each additional vehicle. You can demonstrate this with documents showing how much you earn, how much you pay in taxes, what you own, and your financial statements. Or, you can obtain a document from your bank attesting that you are financially reliable. This is what the law says.

Companies that demonstrate the financial requirement to obtain a license for the transport of goods in the European Union according to European rules can do so by showing a copy of the same license.

What documents must be submitted with the application for registration in the Register of Environmental Managers?

To register, you must send some documents via the internet. Here’s what you need:

  1. An application that the system will give you, signed by the head of the company.
  2. A copy of the identity card of the head of the company that is still valid.
  3. A declaration on the safety of transport means, signed by the head of the company as technical manager, following a specific model established by the national committee.
  4. Photocopies of the vehicle registration certificates, both front and back.
  5. If the vehicles are not owned by the company, you need copies of contracts that demonstrate that you use them exclusively (such as leasing, rental without driver, etc.).
  6. A copy of the license to transport goods at the European level or an international authorization for the transport of goods.
  7. Documents that demonstrate that you have the necessary money to register (such as turnover, VAT payment, assets, financial statements, or adequate bank financing).
  8. A declaration by the head of the company attesting that he has no ties to the mafia.

If you have a company abroad, there are additional documents:

  1. A certification that will be given to you by the competent authority in your country, attesting to the company’s data, such as address, legal representatives, and other important information.
  2. Documents that demonstrate that no legal representative of the company has been placed under interdiction or incapacity.
  3. Documents that demonstrate that the company is in compliance with social security and welfare payments according to Italian law or your country’s law.
  4. Documents similar to a criminal certificate, but issued no more than 6 months ago, for each legal representative.

For some specific requirements, you can follow the instructions in Circular No. 149 of February 2, 2017. Each legal representative must make a declaration.

Remember that all documents must be in the original language, and if they are not in Italian, they must be translated and authenticated by the legal representative.

There are also some expenses to consider:

  • €90.00 for secretarial fees, which you can pay with a credit card when you submit the application.
  • €16.00 of stamp duty, which you will have to pay when you download the registration document via the telematic system.
  • A fee of €168.00 to be paid by bank transfer or postal order to a specific account of the Revenue Agency in Pescara. You must attach the payment receipt during the download of the document.

If there are changes in the company after registration, you must communicate them within 30 days to the regional section, and also in this case, you must do it via the internet.
